1. Acceptance of Terms
By accessing Neka.ng, claiming or registering a business storefront handle (e.g., neka.ng/yourbrand), publishing catalog offerings, or interacting with merchants on the Platform, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree, do not use the Platform.
2. Storefront Handles & Eligibility
A. Handle Ownership: Handles are registered on a first-come, first-served basis. Neka.ng reserves the right to reclaim, suspend, or reassign handles that infringe registered trademarks, impersonate existing businesses, or remain inactive for extended durations.
B. Premium & Protected Handles: Select generic terms and corporate brand names are designated as protected handles and require manual identity verification before acquisition.
C. Age & Capacity: Merchants must be at least 18 years old or legally registered corporate entities in Nigeria with the capacity to enter binding commercial agreements.
3. Merchant Content & Prohibited Conduct
Merchants are solely responsible for the authenticity of product listings, pricing, and services displayed on their storefronts. The following items and activities are strictly prohibited:
- Sale of counterfeit, pirated, or stolen goods.
- Narcotics, weapons, unauthorized pharmaceuticals, or illicit substances.
- Fraudulent pyramid schemes, unlicensed financial loans, or advance-fee scams.
- Publishing false contact details, misleading reviews, or unauthorized third-party imagery.
Violation of these standards will result in immediate storefront termination and potential reporting to law enforcement authorities.
4. Transactions & Delivery Disclaimers
Neka.ng provides the digital directory and storefront software connecting buyers with merchants. Unless otherwise stated, all product purchases and fulfillment happen directly between buyer and seller (via WhatsApp, bank transfer, or integrated payment links). Neka.ng does not physically handle logistics and is not liable for merchant delivery delays, order discrepancies, or refund disputes.
5. Intellectual Property
Neka.ng retains all intellectual property rights to the platform software, designs, algorithms, and branding. Merchants retain ownership of their uploaded brand logos, catalog photos, and business trademarks, granting Neka.ng a non-exclusive license to display them for directory discovery and storefront indexing.
6. Governing Law
These Terms of Service are governed by and construed in accordance with the laws of the Federal Republic of Nigeria, without regard to conflict of law principles.
